Practical Guide: Onboarding a New Representative (Offer Letter to MAS Approval)¶
Overview¶
This guide provides a step-by-step walkthrough for onboarding a new representative, from the point of job offer to successful MAS appointment notification. It covers the responsibilities of HR, compliance, the hiring manager, and the new hire at each stage.
Phase 1: Pre-Offer Due Diligence (Week 1-2)¶
Responsible: HR + Compliance¶
Before extending a formal offer for a representative role, the FI should conduct preliminary Fit and Proper screening to avoid offering a position to someone who cannot be appointed.
Checklist: - [ ] Verify candidate's identity (NRIC for citizens/PRs, passport for foreigners) - [ ] Confirm the candidate is not an undischarged bankrupt (via bankruptcy search) - [ ] Check if the candidate has existing appointment with another FI (via MAS ACRA/RNS records) - [ ] Confirm the candidate holds the required CMFAS examination certificates (request copies) - [ ] Verify educational qualifications - [ ] Conduct preliminary criminal record check (with candidate's consent) - [ ] Review the candidate's employment history for any red flags - [ ] If the candidate is a foreign national, confirm work pass eligibility
Key Decision Point: If preliminary screening reveals issues (e.g., missing CMFAS exams, adverse records), assess whether the issues can be resolved before proceeding with the offer. Consider whether a provisional appointment (Form 3B) is appropriate for candidates relocating from overseas.
Phase 2: Offer and Acceptance (Week 2-3)¶
Responsible: HR + Hiring Manager¶
Once preliminary due diligence is satisfactory, proceed with the formal offer.
Checklist: - [ ] Include in the offer letter that the position is contingent upon successful MAS appointment - [ ] Specify which CMFAS modules are required for the role - [ ] State who bears the cost of CMFAS examinations (if applicable) - [ ] Include consent clause for background checks and Fit and Proper verification - [ ] Specify the start date, noting that regulated activities cannot begin until MAS appointment is confirmed - [ ] Obtain the candidate's signed acceptance and consent forms
Important: The offer should clearly state that employment in the representative capacity is conditional upon MAS approval. The FI may allow the new hire to start in a non-representative capacity pending approval, but they must not conduct any regulated activities.
Phase 3: Comprehensive Background Checks (Week 3-4)¶
Responsible: Compliance + HR¶
After the offer is accepted, conduct the full suite of background checks required for the Fit and Proper assessment.
Checklist: - [ ] Credit bureau check: Obtain a credit report (with the candidate's consent) - [ ] Criminal record check: Conduct a formal criminal record check through appropriate channels - [ ] Reference checks: Contact previous employers, particularly any financial services employers - Obtain written reference from most recent FI employer (mandatory) - Cover: employment dates, role, reasons for departure, any disciplinary issues - [ ] Professional qualification verification: Verify CMFAS certificates directly with IBF - [ ] Educational qualification verification: Verify degrees/diplomas with issuing institutions - [ ] Regulatory history check: Check with MAS for any prior regulatory actions or concerns - [ ] Overseas checks (for foreign nationals): Verify qualifications and regulatory history in home jurisdiction - [ ] Media check: Search for any adverse media reports about the candidate
Documentation: Compile all check results into a Fit and Proper assessment file. This file should contain original or certified copies of all verification documents and a written assessment summarizing the findings.
Phase 4: Form 3A Preparation (Week 4-5)¶
Responsible: Compliance + New Hire¶
Prepare the Form 3A (Notification of Appointment of Representative) for submission to MAS.
Checklist: - [ ] Section 1 - Particulars of Representative: Full name, NRIC/passport, date of birth, contact details - [ ] Section 2 - Educational Qualifications: List all relevant qualifications with dates and institutions - [ ] Section 3 - CMFAS Examinations: Record all passed CMFAS modules with dates and certificate numbers - [ ] Section 4 - Employment History: Complete 10-year employment history with no unexplained gaps - [ ] Section 5 - Regulated Activities: Specify the exact regulated activities the representative will conduct - [ ] Section 6 - Fit and Proper Declaration: Complete all disclosure questions honestly and completely - Criminal records (including spent convictions) - Civil proceedings involving fraud/dishonesty - Bankruptcy history - Regulatory actions worldwide - Previous appointment refusals or cessations - [ ] Section 7 - Undertaking by Representative: The new hire signs the declaration confirming all information is true and complete - [ ] Section 8 - Declaration by Principal: The FI's authorized signatory confirms the FI has conducted due diligence - [ ] Section 9 - Supporting Documents: Attach all required supporting documents - [ ] Internal review: Compliance officer reviews the complete form before submission - [ ] Upload at least 1 supporting document (MAS requires a minimum)
Quality Check: Before submission, have a second compliance team member review the form for completeness, accuracy, and consistency with the background check findings.
Phase 5: Internal Approval Chain (Week 5-6)¶
Responsible: Compliance + Senior Management¶
The completed Form 3A must go through the FI's internal approval chain before submission to MAS.
Typical Approval Flow: 1. Compliance Officer reviews and approves the form and supporting documentation 2. Department Head / Hiring Manager confirms the appointment is operationally appropriate 3. Senior Compliance Manager provides secondary compliance sign-off 4. Authorized Signatory (typically a senior officer) signs the declaration on behalf of the FI
Checklist: - [ ] Route the form through the FI's internal approval workflow - [ ] Each approver reviews and signs off on the form - [ ] Address any queries or concerns raised by approvers - [ ] Obtain final authorization from the designated signatory - [ ] Record the approval chain decisions and dates in the audit trail
Note: Approval chains may have up to 6 sequential approvers depending on the FI's internal policies. The Regnify platform automates this workflow with configurable approval chains.
Phase 6: MAS Submission (Week 6)¶
Responsible: Compliance (Authorized Submitter)¶
Submit the approved Form 3A to MAS through the Representative Notification System (RNS).
Checklist: - [ ] Log in to MAS RNS with the authorized submitter's credentials - [ ] Enter all form details into the system (or upload the pre-prepared form) - [ ] Attach all supporting documents - [ ] Verify all information is accurate before final submission - [ ] Submit the notification - [ ] Record the submission reference number and date - [ ] Notify the hiring manager and HR that submission has been made
Post-Submission: Monitor the MAS RNS for any queries or requests for additional information. Respond promptly to any MAS requests to avoid delays.
Phase 7: MAS Processing and Approval (Week 6-8)¶
Responsible: Compliance (Monitoring)¶
After submission, MAS will process the appointment notification.
Expected Timeline: - Standard cases: 5-10 business days - Complex cases (adverse records, overseas experience): 2-4 weeks or longer - Cases requiring additional information: Timeline resets upon submission of requested information
Checklist: - [ ] Monitor MAS RNS daily for status updates - [ ] Respond to any MAS queries within 2-3 business days - [ ] Keep the hiring manager and new hire informed of progress - [ ] Prepare for potential scenarios: approval, conditional approval, or objection
If MAS Raises Queries: - Compile the requested information promptly - Coordinate with the new hire for any additional declarations - Submit the response through MAS RNS - Document all correspondence with MAS
Phase 8: Post-Approval Actions (Upon MAS Approval)¶
Responsible: HR + Compliance + Hiring Manager¶
Once MAS confirms the appointment, finalize the onboarding.
Checklist: - [ ] Record the MAS approval date and reference number - [ ] Notify the new hire that they are now authorized to conduct regulated activities - [ ] Update internal systems with the representative's appointment details - [ ] Set up the representative's profile on the Financial Institutions Representative Register (FIRR) - [ ] Ensure the representative understands their ongoing obligations (CPD, disclosure, etc.) - [ ] Brief the representative on the FI's compliance policies and code of conduct - [ ] Assign the representative to appropriate business activities - [ ] Schedule the first periodic Fit and Proper review (typically 12 months from appointment) - [ ] Set up CPD tracking for the representative

- Start CMFAS preparation early: If the candidate needs to pass exams, factor in study and exam time before the appointment process begins
- Schedule exams early: CMFAS exam slots can fill up. Encourage candidates to schedule as soon as possible
- Complete background checks in parallel: Run credit, criminal, reference, and qualification checks simultaneously to save time
- Maintain open communication: Keep the new hire informed of progress to manage expectations
- Plan for delays: Build in buffer time for MAS queries or additional information requests
- Document everything: Maintain a complete audit trail of all steps taken, decisions made, and documents collected
- Have a backup plan: For critical roles, consider what happens if the appointment is delayed or objected to
